ZBA Minutes SEPT 20 2012
The Zoning Board of Appeals of the Town of Avon held a meeting on Thursday, September 20, 2012 at the Avon Town Hall.  Present were Messrs. Ladouceur, Johansen, McNeill, Vicino, Ms. Aube and Mr. McCahill Planning & Community Development Specialist.  Mr. Ladouceur called the meeting to order at 7:30 p.m.

PUBLIC HEARING                                                                 September 20, 2012

The Clerk read the call to meeting.

Mr. Ladouceur read the Application of Dimitrios Doupis, owner/applicant; requesting from the Avon Zoning Regulations, Section IV.A.6., a 10’ variance from the 40’ front yard setback requirement and a 12’ variance from the 25’ side yard setback requirement to allow existing 8’x12’ shed to remain, located at 30 Briar Hill Road in an R-40 zone.  He mentioned that Mr. Doupis, the applicant, was the only person present.  

Mr. Ladouceur read the letters from abutting property owners in favor of the application.  Mr. Robert Mattioda, #29  Briar Hill Road, Mr. C. Kelley #22, Mr. Edward J. O’Brien #35, and Mr. Franklin Chamberlain #36 who approved as long as the shed was not visible from his property.  

Mr. McCahill stated that the building official, Jim Sansone went out to this property to do an inspection on another matter and noted the shed.  He believes the applicant was misguided by the shed company and did not know he needed a permit.  

Mr. Dimitrios Doupis said he put the shed there so it wouldn’t impact the neighborhood and is also convenient for him to put it there.  It would be a significant amount of work and cost to move rocks and trees.  If he didn’t remove them the shed would be in the driveway to be within the building lines.

Mr. Ladouceur asked about the neighbor Mr. Franklin referring to the location of the shed and if the shed was in this location before he wrote this letter.  Mr. Doupis replied the shed is in the same location and cannot be seen by him.

There was no one else present.  The Public Hearing closed at 7:38 p.m.

ZONING BOARD OF APPEALS MEETING                  September 20, 2012

A Zoning Board of Appeals meeting was held following the Public Hearing.

Mr. McNeill made a motion to GRANT, seconded by Mr. Vicino the Application of Dimitrios Doupis, owner/applicant; requesting from the Avon Zoning Regulations, Section IV.A.6., a 10’ variance from the 40’ front yard setback requirement and a 12’ variance from the 25’ side yard setback requirement to allow existing 8’x12’ shed to remain, located at 30 Briar Hill Road in an R-40 zone.  The vote was unanimous by Messrs. Ladouceur, Johansen, McNeill, Vicino & Ms. Aube.

Mr. McCahill stated a shed needs a building permit so they can inspect the ground they are sitting on to make sure they don’t rock or tip and frost protection.

Reason – The granting of the variance will be in harmony with the purposes and intent of these regulations.  Will accomplish substantial justice and will not be injurious to the neighborhood or otherwise detrimental to the public, health, safety and welfare.

Hardship – To deny would deprive the owner of a reasonable use of the property.

There being no further business the meeting was adjourned at 7:45 p.m.
